Exposé des motifs

La notion de “résidence” retenue par le texte est trop élastique : elle ouvre la porte à des situations de domiciliation opportuniste, voire fictive, au gré des enjeux électoraux locaux. Le vote municipal engage des décisions structurantes pour la commune. Il suppose un ancrage réel, stable, et non une présence administrative de circonstance. Le critère de résidence principale apporte une clarification simple, lisible et protectrice de la sincérité du scrutin.

Dispositif de l'amendement

À la première phrase de l’alinéa 2, substituer au mot : « résidant » les mots : « ayant sa résidence principale ».
